Professional Membership Terms of Service Agreement

This Practitioner Terms of Service Agreement (“Agreement”) governs the relationship between Arkansas Wellness Collective LLC (“the Collective”) and practitioners who join the Arkansas Wellness Collective network (“Practitioner”). By submitting payment and joining the network, the Practitioner agrees to the following terms.

1. Page Creation Fee & Refund Policy

Upon payment of the practitioner page creation fee, the Practitioner has seven (7) calendar days from the date of payment to request a full refund with no questions asked.

After seven (7) days, the Practitioner’s page will be constructed and made live on the Arkansas Wellness Collective website. Once the seven-day period has passed, the page creation fee is non-refundable.

If the Practitioner decides to leave the network at any point after day seven, their page will be removed from the site, but no refund of the page creation fee will be issued. By submitting payment, the Practitioner acknowledges and agrees to these terms.

2. Annual Membership, Payment Terms, and Optional Services

Membership in the Arkansas Wellness Collective is based on an annual dues structure. Annual membership dues are collected at the beginning of each calendar year and are required to maintain an active practitioner listing within the Collective.

The annual membership rate is locked in for each practitioner as long as their membership remains active. Practitioners will never be required to pay an increased annual membership rate to remain part of the Arkansas Wellness Collective.

Membership dues cover ongoing practitioner listing maintenance, page hosting, and continued inclusion in the statewide directory and network structure.

Practitioners may choose to participate in optional add-on services designed to increase individual visibility within the Collective. These may include featured placements, social media spotlights, educational content participation, or other promotional opportunities offered from time to time. Participation in these services is not required for membership.

If a practitioner chooses not to renew their annual membership, their practitioner page and listing will be removed from the Arkansas Wellness Collective at the end of the paid membership period.

Practitioners may cancel or opt not to renew their membership by providing written notice to Arkansas Wellness Collective LLC at admin@arkansaswellnesscollective.com prior to their renewal date.

3. Intellectual Property – Practitioner Page and Content

Each Practitioner page is custom-built within the Arkansas Wellness Collective website using Arkansas Wellness Collective LLC’s proprietary page design, layout, formatting, and website framework. While the page is published as part of the Collective, the overall page structure, website design, and placement within the Arkansas Wellness Collective platform remain the property of Arkansas Wellness Collective LLC. If a Practitioner leaves the network, their page will be unpublished and removed from the website.

Practitioners retain ownership of all original materials they provide, including but not limited to their biography, photographs, logos, service descriptions, credentials, videos, and other submitted content. Upon leaving the network, Practitioners may request a copy of these materials in their original form.

In addition, any marketing copy, messaging, or webpage content created by Arkansas Wellness Collective specifically for the Practitioner may be used by the Practitioner without restriction after leaving the network. Arkansas Wellness Collective grants the Practitioner a perpetual, royalty-free license to use this written content for their own business, including on their own website or marketing materials.

There are no long-term contracts. If a Practitioner chooses to leave the network, Arkansas Wellness Collective LLC will un-publish the live webpage and provide a PDF copy of the completed page for reference. While the Arkansas Wellness Collective website framework and page design remain the property of Arkansas Wellness Collective LLC, the Practitioner is free to reuse their own content and the custom marketing copy created for them when building a future website or other promotional materials.

4. Marketing & Promotional Use

Practitioners grant Arkansas Wellness Collective LLC the right to use their name, photo, bio, and service descriptions in marketing materials, social media, and promotional content for the network. This includes featuring their practice in directories, testimonials, and advertisements. Practitioners may contact Arkansas Wellness Collective LLC to request to opt out of specific uses.

5. Contributed Content (Blog Articles & Newsletters)

Any blog articles, newsletter contributions, or other written content created by Practitioners remain the intellectual property of the Practitioner. Upon leaving the network, the Practitioner may request removal of their contributed content.

Arkansas Wellness Collective LLC reserves the right to remove any contributed content at its discretion, regardless of whether the Practitioner requests removal. Content may remain published with author attribution or be removed at the network’s sole discretion.

6. Practitioner Conduct & Removal

Arkansas Wellness Collective LLC reserves the right to remove any Practitioner from the network at its discretion. In the event of a violation or concern, we will attempt to contact the Practitioner to discuss the matter before taking action. However, Arkansas Wellness Collective LLC maintains the final authority to remove a Practitioner’s page and terminate their participation in the network.

If a Practitioner is removed from the network due to a violation or conduct concern, they will receive a refund for the current month’s subscription fees, and their membership will be terminated immediately. No refunds will be issued for previous months or the initial page creation fee.

7. Independent Contractor Status

Practitioners are independent service providers and are not employees, agents, or partners of Arkansas Wellness Collective LLC. Nothing in this Agreement shall be construed to create an employment, partnership, joint venture, or agency relationship between the Practitioner and Arkansas Wellness Collective LLC.

8. Limitation of Liability

Arkansas Wellness Collective LLC is not responsible for the quality, safety, or outcomes of services provided by Practitioners listed on the network. Practitioners are independent service providers, and clients use their services at their own risk. Arkansas Wellness Collective LLC disclaims all liability for injuries, damages, or disputes arising from Practitioner services.

9. Data Privacy & Newsletter

Arkansas Wellness Collective LLC collects email addresses from newsletter subscribers to send monthly wellness updates and network information. Subscribers may unsubscribe at any time by clicking the unsubscribe link in any email or by contacting us directly. We do not share email addresses with third parties without consent.

10. Dispute Resolution

Any disputes between Arkansas Wellness Collective LLC and a Practitioner will first be addressed through direct communication between the parties. If the parties cannot reach resolution, disputes will be governed by the laws of the State of Arkansas and resolved through binding arbitration or small claims court, as applicable.

11. Agreement to Terms

By submitting payment to Arkansas Wellness Collective LLC, the Practitioner confirms that they have read, understood, and agree to be bound by this Practitioner Terms of Service Agreement.


Community Listing Member Terms of Service

This Community Listing Member Terms of Service (“Agreement”) governs the relationship between Arkansas Wellness Collective LLC (“the Collective”) and community listing members who join the Arkansas Wellness Collective directory (“Community Member”). By submitting payment and joining the network, the Community Member agrees to the following terms.

Community listing membership differs from full practitioner membership in the following ways: Community Members receive a basic directory entry rather than a fully built practitioner page, and there is no initial page creation fee. All other terms and responsibilities apply as outlined below.

CL-1. Community Listing Fee & Refund Policy

Community listing membership does not require an initial page creation fee. Community Members pay only a monthly subscription fee of $19.00 per month to maintain their directory listing on the Arkansas Wellness Collective website.

All monthly subscription fees are non-refundable. By submitting payment, the Community Member acknowledges and agrees that no refunds will be issued for any monthly subscription fees paid, regardless of the circumstances under which they leave the network.

CL-2. Monthly Subscription & Payment Terms

Community Members pay a monthly subscription fee of $19.00 per month. Charges occur on the same date each month. Community Members will be notified of any rate changes with thirty (30) days’ notice.

If payment fails, the Community Member will be notified and given a reasonable opportunity to update their payment information before their listing is removed. Community Members may cancel their membership at any time by providing written notice to Arkansas Wellness Collective LLC. Contact admin@arkansaswellnesscollective.com at least seven (7) days before subscription renewal in order to cancel membership. Their directory listing will be removed upon cancellation.

CL-3. Directory Listing & Intellectual Property

The directory listing, including its design, layout, and structure, is owned by Arkansas Wellness Collective LLC and will be removed from the site if the Community Member leaves the network.

Community Members retain ownership of any content they provide to Arkansas Wellness Collective, including their business name, contact information, service descriptions, and any other materials they submit. Upon leaving the network, Community Members may request their content in its original form.

CL-4. Marketing & Promotional Use

Community Members grant Arkansas Wellness Collective LLC the right to use their business name, logo, and listing information in marketing materials, social media, and promotional content for the network. Community Members may contact Arkansas Wellness Collective LLC to request to opt out of specific uses.

CL-5. Conduct & Removal

Arkansas Wellness Collective LLC reserves the right to remove any Community Member from the network at its discretion. In the event of a violation or concern, we will attempt to contact the Community Member to discuss the matter before taking action. However, Arkansas Wellness Collective LLC maintains the final authority to remove a Community Member’s listing and terminate their participation in the network.
